Yvette specialises in financing, restructuring and insolvency matters.
She advises and represents clients across a broad range of financing transactions and debt restructurings, including Dutch scheme proceedings (WHOA). Yvette also frequently litigates in these areas, including proceedings before the Netherlands Commercial Court, particularly concerning the enforcement of security interests, insolvency, bank’s duty of care and other bank-related matters. Prior to joining Windt Le Grand Leeuwenburgh, Yvette spent six years at a leading Benelux law firm in London and Amsterdam. Additionally, she was seconded to a bank, where she worked as part of the legal team in both the financial restructuring & recovery department and the asset-based finance department.
Recent significant work includes:
- Advising a company on its financial restructuring through the Dutch scheme proceedings (WHOA), resulting in a debt reduction from €22,000,000 to €4,300,000.
- Assisting the liquidator (vereffenaar) of IHC B.V., former owner of Royal IHC, a world leading shipbuilder.
- Acted as Dutch local counsel for LumiraDx and FTI Consulting LLP in the sale of its point-of-care diagnostics business to Roche Diagnostics Limited for a principal purchase price of USD 295,000,000. The sale took place through an English pre-packaged administration in which FTI Consulting LLP acted as trustee.
- Acting for a high-end agricultural company with negotiating and documenting its €30,000,000 facility agreement.
- Acting for the lender in a €5,000,000 term loan facility for an innovative cleantech company.
- Represented a high net-worth individual in a clean exit out of a promising yet troubled real estate project in The Hague area.
- Documenting internal financing structures (shareholder and intra-group loans) and private/direct lending arrangements for several of our clients.
- The deconstruction of and a post mortem investigation into an innovative, functional and fully licensed Digital Identity platform, held by one of the leading professional bodies in the Dutch legal sector.
